The U.S. Supreme Court has just green-lit law enforcement officers to enter American homes without a warrant.
At least there was some dissent; Justice Alito wrote about the 6-3 decision that, “When occupants of a residence disagree on whether they will admit police without a warrant, the objecting occupant must be physically present. That doesn’t change if police have removed the objector…”
Just turn that over in your mind for a moment and you can start to see how truly dangerous a precedent that is!
Read page 2 for background on the case and ruling:
Nope, don’t need to read case law. The Constitution was written as the supreme law. It’s purpose was to limit the reach of the government. The Bill of Rights was established to guarantee specific rights that neither the US Government nor any individual state government could supersede, without an amendment to the Constitution. This alteration violates the integrity of the 4th Amendment. The purpose of the Judicial branch is to interpret the law, not write it. This is a huge overreach of power, and a substantial loss to our personal rights. This change was necessary for the upcoming gun confiscation, and it is coming. With this, they will search peoples homes when they are not present – shopping, at work, etc.
Ach todd. .. fragt sich WER da rausgetragen wird….
F the police. Devoid of any human value.
F the supreme court. Terrorists – devoid of any human value.
This is going to get people killed.
Not
Looks like ill be shot after shooting them
the stupidity behind comments of “at least I’ll die a free man,” and “better to die on your feet than on your knees,” are simply knee jerk commentary with zero research presented. Warrants have never been needed in situations like the background of this story. In this case they had every right to believe a crime had occurred and to detain Fernandez and any other occupants. Whether you like it or not, this would not be a fourth amendment violation and has gone on for years, while they wait for the warrant to go through.
suspicion alone has never been enough. Probable cause and affidavits have, which again doesn’t negate the fourth amendment.
You win stupid comment of the day. “Most cops don’t like being on the warrant team because of that reason.” SWAT teams are one of the most competitive units to join and make in regards to law enforcement. Stop just seriously stop with your uneducated knee jerk reactions. It is nothing short of pathetic.
