The Texas rancher was living his worst nightmare. He was embroiled in an income tax case with the federal government that was intent on foreclosing on his ranch, taking everything and leaving nothing due to unpaid liens.
The rancher’s effort to fight back turned the incident into a landmark case. On September 14, 2015, he filed a petition in United States District Court, Eastern District of Texas, Lufkin Division Case No. 9:14-CV-138 that challenged the Constitutional authority of the feds to usurp the authority of the courts in Tyler County, Texas.
The United States had 14 days to respond, but remained silent, apparently the first and only time that the government failed to respond to a jurisdiction challenge.
The rancher was not dissuaded. On September 30, 2015, he filed a Demand for Dismissal. Again, there was no response. How can the worst nightmare become even worse? The rancher will likely answer that when the Federal Court in conjunction with the IRS is trying to illegally seize your property while ignoring your legal rights, this is about as bad as your nightmare can be.
All within the rights of the rancher, his petition claimed that the Federal Court lacked the territorial and personal jurisdiction in Tyler Country, Texas, and demanded a dismissal of the case. The text of the petition indicated that the law was on his side.

Wayne Mallard What do you think the definition of public land is?
Actually its not childish its called the constitution. Try reading it sometime. Then explain to me how federal income tax withholding is legal
Anyone who wants to know more about that whole situation should look it up. It is very interesting. The government has been doing shady$#%&!@*to the ranchers in that area for years. All the other ranchers had given up. They were the last hold outs. As a side note, it looks desolate, but just underneath the surface are some very good natural resources. I’m sure that has nothing to do with the government land grab though.
Jarod Strain, yet the Declaration of Independence was specifically written to, and delivered to the king.
Dottie Stough, how can he be a tyrant, he has not yet had any power or authority?
I’m not a Trump fan. I didn’t vote for him. But, he won the election by the rules. He is soon to be our president.
Let’s hope for the best. He could turn out better than expected.
Until he he signs a tyrannical bill, makes a tyrannical executive order, uses the military in a tyrannical action, or launches a nuclear weapon without justification, I will support him and wish him the best. Remember, our success, and his success are bound.
If he gets out of line, then we will remind him that he works for us, the American people.
The article said something about the penalty for constitutional treason being death. Um, the constitution says that treason cannot have a blood penalty
I work at a school. And at this very moment, written on my friend’s classroom board is everything an 8th grader could possibly understand about the constitution, including the reserve clause
Let me know how this goes…
Just being written on a board is NOT enough and I bet very little time is spent teaching and making sure the students understand it. This is One of the Most Important Documents in Our Country’s History and at the very least a year should be used for it’s teaching. If our younger generations don’t know and understand it, this country will cease to exist in the very near future.
We see only the tip of the iceberg I fear.
The real issue here is the federal income tax and wether or not the federal government has constitutional authority to impose an income tax. If the federal government does have constitutional authority then not paying your taxes can have severe consequences like property liens and seizures. Screw that rancher, he did it to himself by his negligence of not managing his tax obligations. I pay the federal income taxes levied against myself and until myself and all citizens are no longer subjected to a federal income tax I can not have sympathy for somebody who fails to pay it.
