It looks like at least one person in our judicial system remembers that they serve the people, not the government.
Ruling in favor of North Carolina convenience store owner Lyndon McLellan, US District Judge James Fox said that the government is to cover the full cost of the legal fees and expenses he accrued defending himself in court. The amount to be paid is estimated to come in at over $20,000.
McLellan’s legal problems arose in May of 2014 when the IRS raided his bank account and seized $107,700 from it. Shortly after taking McLellan’s money however, the government ceased all action against McLellan on account of Justice Department policy changes and returned the money to him.
During the period the IRS was holding his money, McLellan prepared to sue the government only to find himself saddled with a considerable bill after his case was suddenly dropped. Feeling that he shouldn’t have to pay for the government’s mistake, he filed suit.

Your money that you work for isn’t really yours. You have to pay numerous forms of taxes on it, you have to justify why you have a certain amount, if a cop pulls you over and illegally searches your vehicle and finds a few grand they might seize it because *maybe* it’s drug money and nobody should have more than xxx amount. Then you get the grilling of why you have so much. Well, some people do work and bust their asses for a living. Some people sacrifice and work hard establishing and running businesses and unlike the idiot in White House said….we DID build it. Those IRS agents are assholes. A relative of mine was audited a couple of years ago and they determined his business owed them 7K. When he showed up (losing a day of work) to meet their demands with all of his receipts and paperwork that shitbag IRS agent didn’t even look at it. They are making him pay without even checking the paperwork over. Then of course the state revenue service got wind of it and sent him a you owe us 5k letter based on what the feds said. He screwed up and signed a piece of paper before they would let him leave. He didn’t understand it completely and under duress he signed it so he could leave. That was basically the nail in the coffin. If I were him I would have pissed them off. No,$#%&!@*you, I’m NOT signing any paperwork without a qualified attorney present and I will leave unless I am placed under arrest. Go ahead and arrest me for refusing to submit to your c**p, see you in court. Those assheads sent me a letter saying that I had a $300 credit for 2014 and to call, so I did. They told me I never filed my 2014 tax return and they were going to viciously fine me for every month it wasn’t filed. It would have totaled up to about $1,800. Well….the credit letter I had, showed that I had filed a return, it showed it right on the damn thing. I took it to an accountant who said it was b******t. She told me that it couldn’t have been generated w/o having my return and it showed the return form # right on the paper. I had to waste my time photocopying and resending everything anyway. If they never got my return then how in the hell did they even determine I had a credit?????? I just got another one of those letters from them for 2015 that I have an $1,800 credit. I’m not so sure I even want to call because they’ll probably pull the same c**p.

If this story is true then justice was served,I think this law that some government group can just come into your buisness and say Im taking your money because you have to much it must be illegal gain

Civil Asset Forfeiture was meant to hurt drug dealers, and other criminals, NOT fleece innocent people. Gov needs to have solid evidence wrongdoing happened before seizing people’s assets and making it hell to get the assets back.
