Federal Lawsuit Filed Against Ted Cruz Over Citizenship


Ted Cruz has a law suit on his hands regarding his Canadian birth and the question as to whether he is constitutionally eligible to run for President.

The plaintiffs in the Alabama case argue and stipulate that the Second Article, First Section of the Constitution, uses the words ‘natural born’ – meaning ‘native born within the geographical borders of the United States of America or its territories and/or protectorate regions’.

The  lawsuit (adequately) argues that Cruz was, indeed, born inside the borders of Alberta, Canada and that his father was holding a job there at the time when Cruz was born – on December 22nd, 1970.  But according to Immigration law, Cruz is a U.S citizen because his mother was an American citizen – this being the main point of contention within the case itself.

Seeking clarification, the Attorney for the plaintiffs Atty. Thomas Drake II, also demanded in a letter drafted and sent to the Alabama Republican Party, that “an investigation and determination as to Cruz’ eligibility” must be made no later than February 20, 2016.

In an interview this last Friday (February 12th, 2016), Attorney for the plaintiffs Atty. Thomas Drake II, told Fox6 News (WBCR) that it is his contention that Cruz does not satisfy the requirements of the Constitution to be a ‘natural-born’ citizen of the Unites States of America.

Drake was also quoted as saying “At that time News (WBCR) of Mr. Cruz’s birth, at the moment of his birth, the location determined his status. And his status was that of a natural born citizen of Canada, not the United States.”

In addition to filing the suit, Drake demanded, in a letter drafted and sent to the Alabama Republican Party, that an investigation and a determination as to Cruz’s eligibility no later than February 20, 2016.

 

 

Now, nearly TWO WEEKS AFTER the lawsuit was filed, there has still been NO RESPONSE filed in federal court and a spokesperson for the Cruz campaign has declined to even so much as comment on the matter.

Cruz himself has responded to Trump’s question of citizenship during a debate, laying out the legal basis for why is is indeed qualified.  He states that his mother was a United States citizen and then linked his birth to similar scenarios in previous GOP candidates, like John McCain and George Romney, who both ran for president, coming to the conclusion that the “legal issue is quite straightforward.”
