Florida’s Third District Court of Appeals has just made a landmark ruling that the Institute for Justice is calling “a major blow to property rights.”
Tom Carroll and Hermine Ricketts, 17-year homeowners, have been fighting the Village of Miami Shores for the last 6 years. The battle ended in a verdict after 3 years but they fought on. It all started back in 2014 when the couple refused to take the “advice” handed down to them by the town officials keen on implementing a new zoning plan.
The homeowners refused to relinquish their constitutionally protected rights. That is when town officials resorted to plan b.
The couple subsequently sued based on a constitutional infringement upon their right to use their own private property as well as a violation of the equal protection clause.

One reason I would hate living in a planned community. Those HOA rules can get very nitpicky and really curtail what one can do with the property one buys in them.
If I buy a chunk of property, I ought to be able to use any part of it to grow food, if I wish. And that is why I want nothing to do with planned communities. They like to regulate this kind of thing.
Marijuana ought not be classified as a restricted drug. It is a plant with many potentially benecicial uses for humanity and it is a crime that the plant has been classified as an illegal drug.
That’s fine. Purchase your property in a place where no one has to look at ugly vegetables, wherever you want to grow them. I want a peice of property, in the middle of nowhere, so I can do whatever I please, too. Humans have to be considerate of one another, when we choose to live in close proximity.
Crazy….people in Cuba aren’t allowed to grow vegetables on their own property either.
