Florida’s Third District Court of Appeals has just made a landmark ruling that the Institute for Justice is calling “a major blow to property rights.”
Tom Carroll and Hermine Ricketts, 17-year homeowners, have been fighting the Village of Miami Shores for the last 6 years. The battle ended in a verdict after 3 years but they fought on. It all started back in 2014 when the couple refused to take the “advice” handed down to them by the town officials keen on implementing a new zoning plan.
The homeowners refused to relinquish their constitutionally protected rights. That is when town officials resorted to plan b.
The couple subsequently sued based on a constitutional infringement upon their right to use their own private property as well as a violation of the equal protection clause.

Appeal the decision, but we have lost many of our freedoms. There is too much government intrusion into our lives.

Wow all the places that sell seex and plants so you can grow your own will have a huge dent in profits if this is allowed to spread. Higher court should see appeal on this. Bet it would get over turned.
Would have to have the whole story, if its a front yard in a nice place then it fits right in with the fact they can make you paint certain colors on house and cant have a truck in your own drive so more details would be needed to know if this was right or not

I garden in my front & side yards, and there are plenty of veggies. We eat them fresh, canned, frozen & dried. Thankfully we live in an agricultural area where growing your own food is promoted. So glad I live here!
The day I heard about Monsanto trying to ban the sale and use of heritage seeds I said that growing your own food would be next and no one believed. That was 7 yrs ago. And they are doing this while their GMO crops are failing and dying. Blaming global warming. All I know is I planted heritage and store bought lettuce last year and we went 90 days with no rain. I have of course watered however I had accidentally dropped some of the heritage lettuce seeds on the ground. They never saw water. I had inch wide cracks in my lawn and it still grew. The very idea that we can do nature better then nature is so egotistical it’s barbaric. Like when we thought we were the center of the universe
Obviously, Obama appointees, and Liberal to the core. If we can re-elect Trump again in 2020, a lot of these anti-American stooges in black robes will be gone. Even so, we have some decent men and women on the SCOTUS. Obama’s judges should only be on the S*****M, like fleas and bedbugs.
