Something must be very wrong in America for our justice system to call people who commit crime victims and people who are victimized by crime criminals.
It sounds ludicrous, but a case out of Portland shows that the courts are amenable to such blatant nonsense. This is what Dunkirk resident David McLaughlin learned almost certainly to his chagrin when he found himself charged and convicted by such a court.
McLaughlin was minding his own business when he discovered that someone had broken into his garage. The intruder, David A. Bailey, had entered McLaughlin’s home with intent to make off with some of his property, as authorities later confirmed.
Doing what anyone would do when they find a potentially-dangerous intruder in their home, McLaughlin grabbed his gun and fixed it on Bailey. Realizing his mistake, Bailey attempted to flee the scene, but not before McLaughlin shot him in the arm.
Despite clearly being in the wrong, Bailey thinks he’s the victim. So much so, that he has taken McLaughlin to court for shooting him!

While I wouldn’t lose any sleep at all if a criminal trying to steal something from someone’s garage got shot and killed… there IS something to be said for the responses here… It is clear that the vast majority of you here are bloodthirsty goons who probably pray every night that someone will try to break into your house so that you can legally shoot someone… When a guy is fleeing into the night and you are chasing him down the street firing your gun at him trying to kill him, that is absolutely you trying to take advantage of the opportunity to kill someone. The guy clearly poses no immediate threat, and he didn’t even manage to steal anything from you (which, BTW, isn’t punishable by death anywhere in first world civilization)… The perp’s case for compensation should be laughed out of court… However, the punishment to the shooter was not outrageous at all… he could have accidentally shot someone else with a stray bullet in his efforts to bag a legal kill of a fleeing person (that he would no doubt have talked all kinds of trash about for years like it was a tough/manly/dangerous action-hero affair to shoot a fleeing perp in the back). I am totally pro second amendment, but it’s people like you guys that make me able to understand the other point of view, even if I don’t agree with it… too many of you feel that using a gun to kill someone has a MUCH broader range than protecting some innocent person from harm… which is the ONLY case that you should be thinking that killing someone is warranted… Half of you seem to fit in better with the fringe/terrorist Muslim sects (that you likely hate) as far as your version of what crimes warrant death…
