An illegal search of the car of an Ohio student emergency medical technician (EMT) turned up no evidence of any wrongdoing, but police still decided to arrest and jail him for 13 days. The arrest resulted in his expulsion from school and will likely bar him from pursuing his career goals of becoming an EMT and then a fireman.

Apparently, school administrators caught wind of the videos, which led them to believe that Wiser was in possession of weapons, according to The Huffington Post. Police searched Wiser’s car without his permission, discovering a pocketknife, stun gun and airsoft guns. Airsoft guns fire non-lethal, plastic pellets, and are used in sports games. “I didn’t think anything of the Airsoft guns,” sa id Wiser in a statement. “Our school is a technical school, and I was planning on meeting with my Airsoft team after school. My stun gun was locked in the glove box, and the knife was in my EMT medical vest. I bought it at K-Mart and have it as part of my first responder kit for cutting seatbelts.” The pocketknife violates the school district’s zero tolerance policy against bringing weapons onto school property — a class 5 felony. For his crime, Wiser was carted off to jail for 13 days. He is worried that a conviction will destroy his chance at a career in public service. Indeed, he has already been expelled from high school and technical school, and had his participation in the U.S. Army’s Future Soldiers program terminated. “I won’t even be able to be a janitor. I’m 18 years old, and this is going to ruin my entire life,” he said. Now Wiser is on conditional release, forced to wear an ankle monitor and banned from contact with his dying grandfather. He has been told to remove firearms from his parents’ house. Keep in mind that the only crime Wiser was charged with involves the school’s panicked reaction and the police being over-zealous in describing his EMT tool (the knife) as a weapon. where are the legal beagles on this? 18 years old makes him an adult, a knife can be declared as an arm. the second amendment declares we have the right to bear arms.
It’s not a weapon if it is part of his emt bag! I would sue for illegal search and seizure, false arrest and violating his civil rights. I don’t get the part why he can’t visit the grandfather though.

Yup it does ruin your life our judicial system and that criminal record doesn’t leave. I know first hand. Get used to minimum wage jobs or better learn construction. Manual labor will be your life. I’m stuck working a poor paying job due to mistakes as a teen. I think there should be something other than a ten to fifteen thousand expunement . Because with menial jobs that’s your yearly pay. If your lucky. Sucks for those of us who have made mistakes or been caught up in bull$#%&!@* like this people wonder why people sell drugs. There ya go
searches with out a warrant is illegal. just because you or your vehicle is on school ( public ) property doesn’t give them the right to search your person or vehicle. the property belongs to the citizens of that city, county & state. need some restriction to protect people’s rights.
